Tune and Trade sells software. It does not provide financial advice, and the person operating it is not a registered investment adviser, dealer, portfolio manager, or financial planner in any jurisdiction.

Nothing on this website, inside the software, or in any message from us is a recommendation to buy or sell anything. You operate the software on your own account, and every trade it places there is your decision and your responsibility.

01No advice, and no registration

The operator of Tune and Trade is not registered with, licensed by, or authorised by any securities commission, financial regulator, or self-regulatory organisation in any country. That includes, without limitation, the Canadian Securities Administrators, the Canadian Investment Regulatory Organisation, the U.S. Securities and Exchange Commission, the Commodity Futures Trading Commission, and the U.K. Financial Conduct Authority.

02What we actually sell

We sell a subscription licence to a piece of software: an Expert Advisor that runs inside your own installation of MetaTrader 5, connected to your own broker account. The software executes a fixed set of pre-programmed rules. It is a tool, in the same sense that a spreadsheet is a tool.

We never hold, receive, control, or have access to your funds. We never receive your broker login credentials. We cannot see your balance, cannot place trades on your behalf outside the software you installed and configured, and cannot withdraw anything from your account.

03No relationship is created

Subscribing to the software, reading this website, or corresponding with us does not create any advisory, fiduciary, agency, partnership, brokerage, or professional relationship between you and us. We owe you no duty of care in respect of your trading decisions, your account, or your financial position. We are a software vendor and you are a customer of that software.

04Your account, your decisions

You choose your broker. You fund your account. You select your instruments, your risk settings, your position sizes, and your daily limits. You decide when to switch the software on, when to switch it off, when to override it, and when to close a position manually.

Every order placed in your account is your order. You accept full and sole responsibility for those orders and for any loss arising from them, whether the order was placed automatically by the software, manually by you, or as a result of a setting you chose.

05Risk of loss

Trading leveraged products such as CFDs, forex, and futures carries a high risk of losing money rapidly. Depending on your broker, your account type, and your jurisdiction, you may lose more than you deposit.

Markets gap. Spreads widen. Liquidity disappears. Stop-loss orders are not guaranteed to execute at the price you set, and in fast markets may execute substantially worse. No software can prevent this, and ours does not claim to.

Only trade with risk capital — money whose complete loss would not affect your standard of living, your obligations, or your dependants. If the money you would fund an account with is money you need, do not subscribe.

06No performance promise

We make no representation, warranty, or guarantee that the software will be profitable, will avoid losses, will achieve any particular result, or will perform in future as it has performed in the past.

Any performance figures, statistics, charts, screenshots, or account histories shown anywhere by us are historical records of past activity. They are not a projection, a target, a forecast, or a promise. Past performance does not indicate or guarantee future results.

Your own results will differ from any results shown, because your broker, spreads, execution speed, account size, risk settings, and start date all differ.

Hypothetical, simulated, or backtested results carry inherent limitations: they are prepared with hindsight, do not involve financial risk, and cannot account for the effect of real execution or of decisions made under pressure.

07Software provided as-is

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION.

Software contains defects. Ours may contain defects that have not yet been found, including defects that cause incorrect orders, missed orders, duplicate orders, or incorrect position sizes. We do not warrant that the software is free of such defects.

Test on a demo account first. Run the software on a demo account until you understand exactly how it behaves before risking real funds. If you choose not to test, you accept the consequences of that choice.

08Things outside our control

The software depends on systems we neither own nor operate. We are not responsible for any loss, missed trade, or incorrect execution caused by:

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY TRADING LOSSES, LOST PROFITS, LOST OPPORTUNITY, LOSS OF DATA, OR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THE SOFTWARE, THIS WEBSITE, OR THESE TERMS, WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, AND WHETHER OR NOT WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS SHALL NOT EXCEED THE TOTAL SUBSCRIPTION FEES YOU ACTUALLY PAID TO US IN THE TWELVE MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. Where that is the case, the above applies to the fullest extent the law allows, and nothing here limits liability for fraud, fraudulent misrepresentation, or anything else that cannot lawfully be limited.

10Indemnity

You agree to indemnify and hold harmless Tune and Trade, its operator, and any contractors acting on its behalf, from and against any claim, demand, loss, liability, cost, or expense (including reasonable legal fees) arising out of your use of the software, your trading activity, your breach of these terms, or your violation of any law or regulation applicable to you.

11Your eligibility and jurisdiction

Rules on leverage, automated trading, and available instruments differ by country, and some products are restricted or prohibited where you live. It is entirely your responsibility to confirm that:

Nothing on this website is directed at any person in any jurisdiction where publishing or making it available would be contrary to local law. We may decline or terminate a subscription at our discretion.

12Licence, subscription, and access

Your subscription grants a personal, non-exclusive, non-transferable licence to run the software on the number of trading accounts stated at purchase, for as long as your subscription remains paid.

You may not resell, sublicense, share, publish, rent, lend, decompile, reverse-engineer, or attempt to circumvent the licensing of the software. Doing so terminates your licence immediately and without refund.

When a subscription lapses or is cancelled, the software stops opening new positions at the end of the period already paid for. Positions already open continue to be managed by the software's normal exit rules. You remain responsible for those positions.

Subscription fees are billed in advance and are non-refundable except where required by law. Test on demo before subscribing.

13Testimonials and third-party content

Any testimonial or user comment reflects that individual's own experience and is not representative of what any other user should expect. Testimonials are not compensated unless expressly stated. Links to third-party sites are provided for convenience only and imply no endorsement; we are not responsible for their content or accuracy.

14Changes to these terms

We may update these terms at any time by posting a revised version on this page with a new "last updated" date. Continuing to use the software after a change constitutes acceptance of the revised terms. Check this page periodically.

15Governing law and severability

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. You submit to the exclusive jurisdiction of the courts of Ontario.

If any provision is found unenforceable, it shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions continue in full force.

16Acceptance

By subscribing, downloading, installing, or using the software, you confirm that you have read and understood this entire page, that you accept these terms in full, that you understand you may lose money, and that you accept sole responsibility for every trading decision made in your account.

If you do not accept these terms, do not subscribe and do not install the software.
