This page sets out what Tune and Trade provides, what it does not, and who is responsible for what. By subscribing, downloading the software or switching on FOLLOW, you confirm that you have read it, understood it and accept it. If you do not accept it, do not use the software.

In plain words
  • I publish the position held by a strategy on my own chart, for my own account. It is shared for information and education, so you can watch how a rules-based strategy behaves.
  • I do not ask, advise, recommend or encourage anyone to copy it.
  • The software starts in watch-only mode. Copying happens only if you switch it on yourself. That is your decision alone.
  • Every order placed in your account is your order. Every profit and every loss is yours.
  • Futures trading can lose you more than you deposit. Most people who trade futures lose money.
  • Internet failures, computer and power problems, platform and broker problems, server outages, delays, wrong settings, and not understanding how it works are your responsibility, not mine.

1

Who we are, and what we are not

Tune and Trade Inc ("Tune and Trade", "I", "we") makes and licenses trading software. It is not a registered investment adviser, portfolio manager, dealer, broker, commodity trading adviser or introducing broker, and it is not registered with any securities or derivatives regulator.

Nothing on this website, in the software, in any email or message, or in anything else Tune and Trade publishes is financial, investment, trading, tax or legal advice. None of it is a recommendation to buy, sell or hold anything, and none of it is an offer or solicitation to trade. Nothing takes into account your finances, objectives, experience or tolerance for risk.

2

What is published: information and education

I run a rules-based strategy on my own chart, for my own account, and publish the position it holds — for example "long 1", "flat" or "short 1". That position is a statement of what I am doing. It is shared for information and educational purposes: so that anyone can watch, in real time, how a rules-based strategy behaves.

It is not an instruction, a signal, a trade idea, a recommendation or advice to you. It is not a managed account and nobody manages any account on anyone's behalf.

I do not ask, advise, recommend or encourage anyone to copy my position. Whether a strategy that suits me suits you is something only you can judge, and I cannot judge it for you.

I trade for myself. I may change the strategy, its settings or its size, pause it, stop it, or stop publishing, at any time and without notice to anybody. I have no obligation to keep publishing, to publish accurately at any particular moment, or to tell you before I change anything.

3

Following is your choice, and your responsibility

TnT Follow starts in watch-only mode. It shows the published position next to yours and places nothing. It trades only after you press FOLLOW on your own computer, and you can switch it off at any time.

If you switch FOLLOW on, you do so as your own independent decision. By doing so, you accept that:

4

The risk of trading futures

Futures trading involves substantial risk of loss and is not suitable for everyone. Futures are leveraged: a small move in the market is a large move in your account, in either direction. Losses can be fast, and can exceed the money you deposit, leaving you owing your broker. Most retail futures traders lose money.

Only trade with money you can afford to lose entirely, without it affecting your living costs, your debts or your plans. Do not trade with borrowed money.

No results are promised or implied. This website shows no actual, simulated or hypothetical performance. Past results of any strategy — live, simulated or backtested — do not indicate future results. Your results will differ from mine because of delay, fills, slippage, commissions, fees, size and timing, and they may be much worse.

5

Technology fails, and that risk is yours

Automated trading depends on a long chain of things working at once, and any of them can fail without warning. You accept full responsibility for the consequences of any of the following, including losses, missed trades, positions left open, and positions opened or closed when you did not expect:

If something stops working, the software does not close your position for you. Knowing what you hold, and having a way to close it — including a protective stop at your broker if you leave an account unattended — is your responsibility.

6

Knowing what you are doing is your responsibility

You are responsible for understanding futures, leverage and margin; NinjaTrader and your broker's platform; this software and every one of its settings; and the setup guide.

Losses caused by not knowing, not understanding, misreading or not following any of these are your responsibility. That includes the wrong instrument, the wrong account, the wrong size, the wrong setting, an incomplete install, or not noticing a warning on the panel.

If you do not understand something, do not switch FOLLOW on until you do. Use the simulated account first, and ask me by email — asking costs nothing, guessing can cost a great deal.

7

Rules that apply to you

Brokers and prop firms have their own rules on automated trading and on copying or sharing positions with other traders. Some prohibit them and may close or refuse to pay out an account that breaks them. Confirming that your broker and prop firm allow this software, and complying with their rules, is your responsibility. So is making sure your use of it is lawful where you live, and any tax on your trading.

8

No warranty, and the limit of our liability

The software, the relay and the website are provided "as is" and "as available", without warranty of any kind. Tune and Trade does not guarantee that they will be accurate, uninterrupted, timely, secure or free of errors, or that they will produce any particular result.

To the fullest extent permitted by law, Tune and Trade Inc, its owners and anyone acting for it are not liable for any trading loss, lost profit, missed opportunity, or any direct, indirect, incidental, special or consequential loss arising from your use of, or inability to use, the software, the relay, the published position or this website — including losses caused by any of the failures described above.

Where liability cannot be excluded, it is limited, to the fullest extent permitted by law, to the subscription fees you paid in the three months before the event giving rise to the claim. Nothing here excludes any right that the law where you live says cannot be excluded.

You agree to indemnify Tune and Trade Inc against claims arising from your trading, your settings, or your breach of these terms or of any broker's or prop firm's rules.

9

The subscription

A monthly licence to use the software on one computer, billed by Stripe. You can cancel at any time from your billing page; access continues to the end of the period you have paid for. The licence stops the software opening new positions when a subscription ends, but never stops it closing one. These terms may be updated; the date at the top shows the latest version, and continuing to use the software means you accept the current one.

10

What you confirm

By subscribing, downloading the software, or switching on FOLLOW, you confirm that:

You confirm it twice: by ticking the box before checkout, and again in the software itself — FOLLOW will not switch on until you tick 0. Risk disclosure in its settings. Each time FOLLOW is switched on, that acceptance is recorded against your licence on our licence server — the time, the version of these terms, the size, whether the account is simulated or live, the name label you chose and your IP address — and in NinjaTrader's Output window on your computer. Your balance and account number are never sent.
